End User Licence Agreement

END-USER LICENCE AGREEMENT

This End-User Licence Agreement ("Agreement") is a legal agreement between you ("User") and Frazer Stockton ("Author") for the use of BadHop ("Software"). By installing, copying, or otherwise using the Software you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.

1. GRANT OF LICENCE

a. Free Version
The Software may be used free of charge, with no time limit, subject to a limit of three (3) concurrently monitored targets. All other features are available in the free version. Monitoring more than three targets at once requires a valid licence under clause 1(b), 1(c) or 1(d) below.

b. Trial Licence
The Author may issue a trial licence, valid for a fixed term stated within the licence itself, which removes the three-target limit for that term. A trial licence is issued to a named individual or organisation, is personal to them, and may not be transferred or shared. On expiry the Software continues to operate under the free version terms in clause 1(a); no data is lost and no functionality other than the target limit is affected.

c. Personal Licence
An individual may remove the three-target limit for personal, non-commercial purposes by purchasing a Personal Licence from badhop.co.uk, at the price published there at the time of purchase. A Personal Licence is perpetual (it does not expire) and permits installation on devices you personally own or control. It includes 12 months of software updates from the date of purchase, as described in clause 2.

d. Business Licence
Any use of the Software within, or for the benefit of, a business, for-profit company, sole trader, contractor, or in connection with the delivery of paid services to third parties requires a Business Licence purchased from badhop.co.uk. Business Licences are sold per seat, at prices published at badhop.co.uk (which may include discounts at higher seat volumes). A "Seat" means a single active installation of the Software. To move a Seat to a different device, remove the licence from the old device using the Remove Licence control in the About screen, or contact the Author if that device is no longer accessible. Business Licences are perpetual and include 12 months of software updates from the date of purchase, as described in clause 2. Use of the Software in a commercial context without a valid Business Licence constitutes infringement of the Author's intellectual property rights.

e. Discretionary Licences
The Author may, at their sole discretion, grant extended trials, complimentary licences, or reduced-fee licences to any individual or organisation. Such grants are made entirely at the Author's discretion, do not create any right or expectation of similar treatment for any other individual or organisation, and may be declined or withdrawn at any time.

2. UPDATES AND SUPPORT

Personal and Business Licences each include 12 months of software updates, calculated from the date of purchase. After this period, the Software will continue to function under a perpetual licence, but further updates require renewal on terms to be published at badhop.co.uk. Business Licence holders receive priority handling of support requests on a best-efforts basis. No service level agreement is offered or implied; response and resolution times are not guaranteed.

3. RESTRICTIONS

You may not: (a) copy, reproduce, or redistribute the Software except as expressly permitted in clause 1; (b) modify, adapt, translate, reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software; (c) create derivative works based on the Software; (d) sublicence, sell, rent, lease, lend, or transfer the Software or any rights under this Agreement to any third party; (e) remove, alter, or obscure any copyright notice, trade mark, or proprietary legend contained in or on the Software; (f) circumvent, disable, or interfere with any licence validation or trial-limiting mechanism within the Software.

Third-party components. The Software is distributed with third-party components which are licensed to you under their own respective licence terms, not under this Agreement. Those components, and the licences applying to them, are identified in the accompanying LICENSE.txt and in the LICENSES directory. Where any term of this Agreement conflicts with the licence of such a component, that component's own licence prevails in respect of that component, and nothing in this Agreement operates to restrict, diminish, or impose further conditions upon any right granted to you by it. The restrictions in this clause 3 apply only to the Software itself and not to those components.

4. INTELLECTUAL PROPERTY

The Software, including its source code, visual design, algorithms, data structures, and all accompanying materials, is the exclusive intellectual property of Frazer Stockton and is protected by the copyright laws of the United Kingdom and by international copyright treaties. No title to or ownership of any intellectual property is transferred to you by this Agreement. All rights not expressly granted herein are reserved.

5. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. THE AUTHOR DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION OR ERROR, OR THAT ANY DEFECTS WILL BE CORRECTED.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRAZER STOCKTON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE AUTHOR'S TOTAL AGGREGATE LIABILITY TO YOU UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR TEN POUNDS STERLING (GBP 10) IF THE SOFTWARE WAS PROVIDED FREE OF CHARGE.

7. NETWORK DIAGNOSTIC DISCLAIMER

BadHop performs network diagnostic functions including ICMP ping and traceroute. You are solely responsible for ensuring that your use of these functions complies with: (a) all applicable laws and regulations; (b) the acceptable use policies of any network you connect to; and (c) any permissions required from network owners or administrators. You must not use BadHop to probe or test networks you do not own or have explicit written authorisation to test. The Author accepts no liability for any consequences arising from the use of BadHop's network diagnostic features.

8. DATA, PRIVACY AND LICENCE VALIDATION

The Software's monitoring functions do not collect, transmit, or share your network diagnostic data, including ping results, traceroute results, or captured packets, with the Author or any third party. This data is stored locally on your device only.

Licence keys are verified entirely on your own device, using a cryptographic signature checked against a public key embedded in the Software. No licence key, device identifier, or any other information is transmitted to the Author or to any third party for this purpose. The Software makes no network connection other than to the monitoring targets you specify. Payment processing for Personal and Business Licences is handled entirely by a third-party payment provider; the Author does not receive or store your payment card details. 9. TERMINATION

This licence is effective until terminated. It will terminate automatically and without notice if you breach any provision of this Agreement. Upon termination you must immediately cease all use of the Software and destroy all copies in your possession or control.

10. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the law of Scotland. The parties irrevocably submit to the exclusive jurisdiction of the Scottish courts in respect of any dispute arising out of or in connection with this Agreement.

11. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Frazer Stockton regarding the Software and supersedes all prior agreements, representations, and understandings relating to its subject matter.
